Hi,
I am the manager for a Twin Cities based band named Alysium. They have recently become concerned because their is a Texas based company named Alysium Corp, which is a subsidiary of AuGRID Corp. I did some research and it looks like they aquired Alysium Corp in 2003, but the band was formed in 2000/2001. Who has the rights to this name? Or does it even matter, can a band have the same name as a company? any help would be greatly appreciated.

Who has the rights to this name? Probably both of you, but neither likely has the right to stop the other from using the name.
Or does it even matter, can a band have the same name as a company? In many cases, yes, they can both have the same name. Now, if the mark acquires the status of a "famous" mark, then the other guy might not be able to use the name -- you couldn't name your band "Coca Cola," for example -- but there really aren't that many "famous" marks out there.
