Protecting your website's design?

Hi all,
I have created a website some time ago and I've found a site that looks extremely similar to my site. Now, they have not taken any graphics or HTML code but they have made it so it looks and behaves very, very similar to my site. Basically, they've "stolen" the look & feel of it (i.e. their logo -- diff. from mine -- is at the same place on the page, menus are the same, graphics look extremely similar -- but are not exactly mine).
What can I do? Is there a way to protect against it?

Apple claimed windows XP had the "look and feel" of MAC OS
millions of dollars later.. they lost..
if they are not stealing the actual images, text I'd say you don't have much of a case.. HTML code is HTML code.. I can't sue you because your using the <Header> on your webpage.. you might get somewhere if 90% of the HTML code is copied exactly from your site..

If you went to the correct places you would find dozens and dozens if not hundreds and thousands of sites with the exact same 'feel' as this one.
If it is something exclusive to you and no one else you MIGHT have a case otherwise read the previous post.
