Discussion: What is the name of your state? NY What kind of procedure/form(s) would i need if i have someone who wants to give/sell me the rights to his picture/s? Can a part of the contract be that he is not allowed to sell these pictures anywhere else? (i want the rights to them so i can sell them) thanks Answer: What is the name of your state? Can a part of the contract be that he is not allowed to sell these pictures anywhere else? (i want the rights to them so i can sell them) thanks You just need to figure out what the rights are worth, write up a contract, sign it and pay the man. You can either purchase a license to reproduce and sell the works, either exclusive (which means no one else but you could sell) or nonexclusive, or you could purchase the copyright itself (if he has no further use for it). If he is unwilling to sell you the entire copyright outright, you may want to enlist the aid of an attorney to help draft the license agreement, to make sure it covers what you want and that it will be enforceable if it ever comes to that. If you are just buying the copyright outright, you can write the contract yourself, just make sure that the work you are buying the copyright to is correctly identified, and make sure he signs it. The other thing to consider about a license is that there are several rights that a copyright holder has, including the right to control reproduction, distribution, public performance, and the creation of derivative works. If you buy the copyright, then you would control all of these things. However, if you purchase a license to simply reproduce and distribute the work, even on an exclusive basis, he would still retain the right to publicly perform his work and allow others to create derivative works. That's another reason why an attorney might be helpful in drafting a license agreement. Answer: Do i include the pictures in the contract to make it clear what pictures i am talking about. Answer: Do i include the pictures in the contract to make it clear what pictures i am talking about. Probably wouldn't hurt. Make sure that the written contract specifically notes that the pictures are attached (i.e., "integrates" the pictures into the contract), and give each picture a number or other identifier that you refer to in the contract and mark each picture with the identifier, and make sure that somewhere above the signature line you specify how many pages there are in the agreement and how many photos should be attached. Answer: Thanks for you help I forgot to mention they are photographs, i am assuming the same procedure is done... Copyright © 2006 - 2008 www.todayquiz.com
