Payola on the Internet
Discussion: What is the name of your state? CT I wasn't sure which forum this question should be placed. I think this forum is the best fit. I was wondering what the actual payola law states in regard to online radio "broadcast"? Do the payola laws only apply to broadcast radio, or do they also apply to online web radio? The reason I ask, is there are many sites, such as garageband.com, that have deals where an artist can pay a certain amount to get online radio air-play. So if anti-payola laws do apply to internet radio, in what ways is this not considered payola? Another question I have is, which government office enforces the internet laws for the U.S.? I contacted the FCC with this same payola question, but they responded saying that the FCC has no control over the internet. I'm asking these questions because I'm a music industry major in CT, and I'm trying to get a grasp on the laws that deal with music and the internet. I'm looking to go into a field that combines both music and internet eventually. Any help on this topic would be appreciated! The current laws apply only to broadcast radio. See 47 USC 508, . Another question I have is, which government office enforces the internet laws for the U.S.? I contacted the FCC with this same payola question, but they responded saying that the FCC has no control over the internet. The FCC only covers broadcast. There doesn't appear to be any federal agency the currently has oversight over the internet with respect to "payola." The Copyright Office is responsible for setting the rules related to compulsory licensing of copyrighted works on webcasts, but has no repsonsibility for payola in any way.
