Right of first use & Trademark
Discussion: Georgia but selling all over the USA. I have a company registered in Georgia that manufactures and sells hot sauces. My sauce sell all over the USA. Recently someone has applied for a trademark using the same name. They are wanting to try sell these sauces in other states. if they send me a letter to try force me to chenge my name what rights do I have. I also sell over the internet. Thanks If you have been using the mark prior to their registration, you can keep using the mark -- they cannot keep you from using the mark. They may, however, be able to keep your company from growing, by limiting NEW uses of your mark. Mayeb you should go talk with a trademark lawyer, and see about contesting the registration.
