If I download a photo off the internet and use it to create an original work of art in paint, charcoal, pencil, pen or what have you, can I sell the art work or sell prints of the art work? What if modifications are made that deviate from the photo either a little or alot?

Thanks. From a strict legal standpoint, what you are suggesting is copyright infringement, even with the modifications.
From a practical standpoint, however, unless the photo is a very well-known photo, or the photo has some very "unique" aspect that makes it identifiable, it's unlikey that anyone would connect the art and the photo and claim copyright infringement. It could happen, but its probably unlikely.
