copyright infringement risk?
Discussion: What is the name of your state? Oregon Can a toy company have a copyright on a shape of a piece of paper? As long as the paper does not have their character but its in the same shape and color but not mentioned in my discription or web search? Can they sue me for copyright infringment just by me cutting out a piece of paper and it looks like their product? I looked at all their products and if there is a character on the piece of paper it has a copyright that I understand but can I make this item with no character and sell it as long as I do not use their slogen or words? Can a plain piece of paper in the shape of a star be copyrighted or a trademark? Answer: What is the name of your state? Oregon Can a toy company have a copyright on a shape of a piece of paper? Based on the hypothetical descriptions you've given, it's hard to say whether or not their is a copyright on the object or not. Shapes and designs can be copyrighted and trademarked -- whether or not the particular shape or design you are talking about is or not will depend on a review of all of the facts and the actual shape itself, and what makes that shape special. You would be well-advised to talk with a local attorney, who can review all of the relevant facts and the actual shapes and advise you accordingly. Copyright © 2006 - 2009 www.todayquiz.com
