Legality of "mixtapes"
Discussion: I'm in california, but i'm wondering if this applies to other states as well. Is it legal to distribute "mixtapes"? They're a compilation of various songs on a CD. Most of the time the tracks have not been cleared by the record company, they could be freestyles, instrumentals, or remixes of songs. My question is, is it legal to distribute these CDs? Wouldnt it it be copyright infringement? From what i know, most venues are selling these mixtapes as a free promotional copy to accompany another mechandise. Is this "loop hole" viable? or is it illegal to do so regardless? Answer: You must have the permission of the copyright owner if you want to sell or give away copyrighted material.
