I have recently received a letter from an attorney in NY informing me that I had been selling counterfeit purses on ebay. To their client's request, they are demanding that I stop any selling, advertising, etc. A fax from me to them was expected within 24 hours confirming that I stop the activities mentioned above as well as a complete inventory of what I may have on hand.
This fax is to be followed by a letter/package sending them samples of the counterfeits and also receipts, invoices, etc.
I have sold two of these purses and I had 3 more listed on ebay when this came in. I have obviously stopped everything at once and now that I have learned my lesson, I am asking you guys out there what you think the legal ramifications might be. Firstly, should I send the fax back giving them all that info without it hurting me if and when formal proceedings are commenced. Same question goes for the samples.

Even seling one countereit purse is trademark infringement. Unless you are certain that the purses are real and not fake, you really don't have many options. Cooperating with them may be the easiest and cheapest way out for you. If you are worried, you could talk to a local attorney, who can review all of the facts and advise you accordingly -- but don't ignore this, it's not likely to go away on its own.
