What is the name of your state? - Australia
Okay, I have recently began work on a new Australian Auction site, but unfortunately a few $grands into the project I discovered an American domain with the same name, except it looked to be 'abandoned'. Upon emailing the owner of the domain, he told me that the name is trademarked.
So does that mean I cannot use it in Australia? Because the name I am using best reflects the Australian Market. Is there a way around that? For example using XXX Auctions, instead of just XXX

EDIT: I dont want to offend anybody, if I posted something inappropiate I am sorry, but i find it very frustrating when all i get is US LAW only, if you guys dont know the answer, state that, and explain that the people here know best about US laws and i'll understand. Ive seen this so many times on IRC, a guy, who might not know much about computers comes into a #PHP channel, and asks if anybody can find a way to change the Firefox homepage, and was greeted with over 10 'google it yourself, and this is PHP channel only', yet none of these bothered answering his question anyway. I thought you guys were here to help people, not to mark your territory

I thought you guys were here to help people, not to mark your territory We are here to help -- but we are all U.S. attorneys (at least, those people on this site who happen to be attorneys in the first place), and it's even states at the top and bottom of the page "US Law Only." You need to find a similar site that deals with Aussie law, or talk with a local attorney to get an accurate answer to your question under Australian law.
