If my TM is registered, can I still be sued for infringement?

Discussion:
What is the name of your state? Ohio
I have a business name that *may* be considered "confusingly similar" to another business's name (which is trademarked).

I'm going to submit a trademark registration application with the USPTO this week, and I'm wondering what degree of protection my trademark will have if they do indeed approve my registration.

Can another business still sue for infringement, even though the USPTO approved my trademark?

In other words, if two business's have trademarks, can one still sue the other for trademark infringement?

While I'm not going to divulge my business name, it's basically similar to this example:

My business: Bed Mart
Competitor's business: Mattress Mart

Thanks in advance!
Answer:
Can another business still sue for infringement, even though the USPTO approved my trademark? Sure. The USPTO is not perfect. When you receive a registration for a trademark, your trademark is presumed valid -- but that's only a presumption, not an absolute, and it is possible for that presumption can be challenged and overcome in court. But don't get your hopes up -- the USPTO is pretty good at weeding out trademarks that trample on a "senior" holder's mark. Further, the "senior" markholder can always challenge the registration of another's mark.
In other words, if two business's have trademarks, can one still sue the other for trademark infringement? Yes. But I don't think it happens all that often, because the USPTO is pretty good at screening trademark applications. Not perfect, mind you, but pretty good.
