I made a design in a patriotic font and embroidered it on a cap with lettering FDNY for local firemen. Wanted to show honor to those in recent disaster. I looked and NY fire dept has posted a filing for a trademark on FDNY in the font we've seen on the TV. Though my font is totally different, is this an infringement - in other words, does the word FDNY carry a trademark or the FDNY in that particular font. And even though they aren't trademarked yet, doesn't filing show an intent and prohibit me from selling this particular design? GEORGIA

States it's a typed drawing and they have sold the item- they sell many different tees etc. but the very thing you know belongs to them is that FDNY in that particular font on the gear they wear- it's on hats etc. on their own web site.
