Licencing of photographs of sport figures
Discussion: If I take a picture of a public figure or sports personality, for example a race car driver, can I post the image for sale on the Internet without obtaining permission from the subject? These are all images taken at/during competition. Answer: Good Question - I would like to see an answer to your question. If you don't get a response from an attorney in this forum, you might contact the sports department of one of your local newspapers. Newspapers may fall under the category of "fair use" or some other exception; whereas, you may not. I know the movie industry frowns on taking pictures and recordings of movies in movie theatres; however, a movie is copyrightable, and I am not sure a sports event is copyrightable. A similar, but much broader question, was asked by CHRISPR on 08/21/2001; however, the answer pertained only to taking pictures of copyrighted material such as movies.
