Protecting Your Idea
Discussion: What is the name of your state? NC How do protect an idea? If you have an idea to propose to a business or non-profit, in which they would become a partner is this project, how do you protect your idea from being taken by the business etc? Answer: An "idea" alone is not protectable by IP law (copyright, patent, trademark) -- only the "expression" of an idea. However, in general, if you want to pitch a proposal to a company and you are worried about protecting your stuff, have an attorney draft a non-disclosure agreement (NDA) for the opposite side to sign before you make your pitch -- that will give you a contractual basis on which to seek a remedy if the other side misappropriates your stuff.
