Our forum is being copied, with usernames too
Discussion: What is the name of your state? Ontario, Canada. --- I know many may not be familiar with Canadian laws, but neither am I, so just thought I'd check in case anyone knows. We run a very large support forum, very much like this one "Free Advice", but related to health issues. A new forum started, and we realized their forum content is word for word stolen from our forum posts. What's worse, is they also copied the poster names. So to any observer, it will look like we gave them our database content, to mirror our forum. But one difference is that the poster names appear as "guest" accounts. i.e., all my posts made to our forum, show up under my name on their forum, but I have no access to my account on their forum, and cannot edit or delete these posts. We have contacted them by phone, and they claim it's just a coincedence, and they are not prepared to delete what their "guests" have posted, or the names they chose to post under!!!! I'm assuming their "guest" account, is to avoid identifying who's copying our posts, and can't be made to reveal any info on those guests, as they have no accounts on their forum. Next step was to contact their host, which turned out to be served from their own home, through a DSL connection. So we contacted the ISP, who said they cannot do anything, unless ordered by a court. Any insight on this? Our site is not a business, so we cannot afford a full blown law suit, maybe a couple of hundred dollars from my pocket, but not more. So are we helpless to do anything? Answer: My response: If you can't afford to exercise any rights that you might have under the law, then what do you expect us to tell you? First, anything we would tell you would be based upon U.S. law, which may or may not be applicable to Canadian law. Second, even if we knew the law that's applicable, you don't have the capability to do anything with it, anyway. So, basically, your post amounts to a "I need to bitch about my problem" type post. Well, bitching sometimes makes one feel better. However, hiring a lawyer is not allways the required solution to 100% of the cases. Some ISP's are obligated to certain standards of conduct, from what I've read. My post was an attempt to find out if there are other options. So it wasn't ignored, it was elaborated on. I don't know what's your problem, if it bothers you so much, please feel free to delete it.
