Proving access?
Discussion: Oklahoma How do I prove that a person had access to my work? If I put my songs and/or stories on a website is that proof enough that they had access or do I have to prove that they actually opened the site? What if I play a field concert for 500 people and someone takes one of my songs three states over to his girlfriend's sister's brother-in-law’s garbage dude, and the garbage dude records my song? Do I have to prove that he was at the concert or that he had access to someone who was? Any help will be greatly appreciated. Thank you for your time, Jared Answer: I ask my self.... "What would Jared do?" Now how in the hell can you expect an answer to such a broad question? First, what is the EXACT circumstance that you would like to konw about? Is there a pending copyright case? Do you have a disagreement with someone using your material? What? Answer: I'll try to make my question a little less broad. Do I need to take any other steps besides making my work available to the general public to prove that someone had access to my work even if they were not in the state where the work was performed? If I put my work on the web, is that proof enough in court that my work was available to someone who would possibly infringe on my copyright? Answer: IS someone infringing on your copyright or not? Answer: No. I am just trying to make sure I am doing everthing possible to protect myself in the future. Answer: In that case, BEFORE you make any music, transcript or other work widely available, date it, provide copies to an attorney or in a safe deposit box, send it to the county clerk to file (about $10 a copy) or otherwise have it recorded (not on tape or CD) so that if anything should happen, you can produce a copy showing when it was registered/filed. I published long ago and although I had a publisher to help protect me, as I was looking for one, I would continue working on the book and send drafts to my attorney to hold in unopened sealed envelopes. They would stamp a received date on them and put them away. Never had cause to use those copies, but if I had it would have shown my work was created at a certain date and time.
