For a photograph to be valid as evidence, what are my limitations? That is, can I photograph a subject who is on private property from anywhere (except on the subject's property)? I am a student of criminal justice and private investigation and this issue is part of my education - the instructor does not have the answer. My response: It all depends upon where your "subject" is located; e.g., on the front lawn in plain view, or behind closed doors. Look up the "Expectation of Privacy". IAAL Answer: Thank you. The situation was outside on private property. I will search for "expectation of privacy" for my answer. I actually knew that, but did not connect it with my problem. Again, thank you.
