legal use of trademark?
Discussion: What is the name of your state? Colorado Question 1: I am building an e-book that only contains basketball statistics for a specific NBA season. As far as my research has uncovered, these statistics are historical facts and are non-copyrightable; thus I can copy them and put them in my ebook? Question 2: These basketball statistics are from an NBA season. Can I use the trademark "NBA" in the e-book and in the e-book's title if it is only in a descriptive manner? ... the statistics are from an "NBA" season. The title of the e-book would be something like "2001-2002 NBA Season Statistics" where I use "NBA" to describe the statistics as being from the NBA as opposed to a European Basketball league or an Australian Basketball league, etc. All feedback is greatly appreciated, Sincere thanks, Jon Answer: These are not necesarily historical facts and may be copyrightable (unless you yourself compiled them.) For example, with Major League Baseball, a company called Elias compiles all of the statisitcs under contract from MLB. Elias OWNS the statistics, and their use must be licensed. I would check if those for basketball are the same. Answer: The Moniker "NBA" is a registered trademark as are the proceeds of the product (i.e., basketball season).
