Removal of pictures?
Discussion: New Jersey My ex-girlfriend has a website of scrapbook layouts she made. They all include pictures of us and of me. We have since broke up. I would like her to remove all pictures of me, and to stop using anything with my image. She enters contest with her layout that include me and she did win one. Is there any way to have her remove my image from the site and to stop using my image to profit from or advertise her work? Answer: My response: Nope. At one time you gave her your permission. Notice I said the word "gave". That means, those pictures that now appear are hers to do with as she pleases. They are her property. You "gave" them to her. IAAL Answer: I thought she needed written permission to use them. What if she cant prove I gave her permission. Answer: Originally posted by civickid02 I thought she needed written permission to use them. What if she cant prove I gave her permission. My response: Do you have the money for a lawsuit? IAAL Answer: more then likely Answer: My response: Since you'd be the plaintiff, it would be YOUR burden of proof that you DIDN'T give her permission. Remember, she's in the pictures too, and has just as much right to ownership and usage as you would. So, how much money do you think this would cost you, considering there are no actual damages, and an attorney would want an hourly rate? IAAL Answer: I dont know. But this mean I can do whatever I want with the pictures also?? Answer: My response: Have a nice evening. I don't feel like dancing anymore. IAAL Answer: Never asked you to in the first place.
