Provisional patent application
Discussion: What is the name of your state? WA. Can a provisional patent be applied for using photographs rather than drawings? Thank you, F. Answer: In general, no. 35 U.S.C. 111 (b)(2)(B) requires that provisional patents include a drawing as prescribed by 35 USC 113. An applicant can submit a petition to the office to use photographs in lieu of drawings; although these petitions are very rarely granted for utility patents, if such a petition is granted, then it would be possible to use photographs rather than drawings. See MPEP 608.02 or 37 CFR 1.84 for more information. Personally, I have never heard of an instance where such a petition has been granted, but you never know... I am assuming you are talking about a utility patent; for design patents, it's a whole 'nuther ball game... Copyright © 2006 - 2009 www.todayquiz.com
