Software Code Theft
Discussion: What is the name of your state? Maryland We have small business selling industry specific software and have been doing this for over 8 years. We have inadvertantly discovered that it is likely someone has repackaged our copyrighted software under another name and sold it to at least one customer. We are researching this now, but it seems pretty clear what has occured. Would this be a criminal action or just a civil action? What is our recourse when whe confirm our worst fears? Answer: I am familiar with the Business Software Alliance. they work to prevent software piracy. I do not believe they would apply in this case as their membership companies are Microsoft and other very large package software makers. We are not members. We are a small company and our software is proprietary. Whoever has done this has not simply copied a disk or loaded it on someones computer, and charged them for the software, they have programmed it to their label and are selling it as if they developed it. Theft more than piracy I think? Answer: Contact your local police department and see if they will take a theft charge against the subject. The problem is that most police departments, and certainly no rural ones, have the ability to investigate software piracy issues, so you will likely have to do your own investigation. As for civil action, talk with a local attorney about the theft of secrets, etc. claims that you can consider.
