I am an amateur photographer and recently subscribed to a website where i put my details on to advertise my services, you also have an option to add photographs to a portfolio section which i did.
I have received an invoice this morning from someone advising me that i have breached copyright laws by displaying a photograph in my portfolio which they have copyrighted and they are asking for £1400.00. I was not aware that this photograph was copyrighted as it does not state this on the photgraph itself or on the website i found it. I never stated on my portfolio that this was my work either. I deleted my account with this website as soon as i was aware of my mistake, the photograph would have been displayed for less than 24 hours.
The invoice i have received does not state a company name, phone number or e-mail address. It has no copyright details of the photograph in question just an attatched piece of paper with my portfolio printed out on it displaying the photograph. All i have is the persons name and address. I have called residential and business directory enquiries to obtain a phone number but they do not have one. I have a ran a postcode search on the address and that is correct. There is an invoice number but there is no vat added to the £1400.00 and no vat registration number on the invoice either even though there is a section for that on the invoice.
This was an honest mistake, which i rectified as soon as i was aware of my error but i am very worried about this. Could someone please advise me on my legal position
