Discussion: What is the name of your state? Canadian owned website VS Jehovah's Witnesses, AKA Watchtower Bible & Tract Society. Greetings. One of my colleagues has a website that is devoted to examining the teachings and beliefs of the jehovah's Witness religion. Well he just got a cease and decist from them in regards his website, which I have listed below. Answer: A cease-and-desist letter means they want your friend to stop whatever it is he is doing. If they are coming after your friend, then they will need to sue him in a court that has jurisdiction over him, and that means a Canadian court -- so you'll need to see a Canadian lawyer, regardless of where the site is actually hosted. Now, if the site is actually hosted in the U.S., then there is a law that allows ISP's to avoid any liability for hosting infringing materials if they remove said materials upon the request of the copyright holder. If they recieve the request and remove the materials, your friend will have a certain amount of time to "rebut" their claims, and argue for fair use. Once the ISP receives the rebuttal, then the ISP contacts the copyright holder, and the copyright holder has so many days to either file a copyright infringement cuit against the website owner, or drop it, in which case the pages go back up. If they do decide to file an infringement case, again, they have to do it where they have jurisdiction over your friend, which means Canada, which means a Canadian lawyer.
