Publication of photos of tombstones
Discussion: What is the name of your state? Texas My sister and I are writing a book about tombstones of Texas. We were wondering if tombstones are considered "copyrighted" or would it be okay to publish photos of them in a book without getting permission from the families, cemetery associations or the tombstone "artist". If the photos are taken from a "public" vantage point, then you can take and use the photos as you wish -- whether taken in the day or in the night! A public vantage point is any location that is generally publically accessible -- so if the graveyard allows the public in (even if it is otherwise privately owned), then it is a public vantage point.
