Publication of photos of tombstones

My sister and I are writing a book about tombstones of Texas. We were wondering if tombstones are considered "copyrighted" or would it be okay to publish photos of them in a book without getting permission from the families, cemetery associations or the tombstone "artist". We don't want to infringe on anyone's privacy or rights. Thanks in advance for your help.

If the photos are taken from a "public" vantage point, then you can take and use the photos as you wish -- whether taken in the day or in the night!
A public vantage point is any location that is generally publically accessible -- so if the graveyard allows the public in (even if it is otherwise privately owned), then it is a public vantage point. If you have to get special permission to enter, then it is probably not a public vantage point.
