Selling photos of public event
Discussion: What is the name of your state? Oklahoma. I recently took photos of an offshore boat race in Key West Florida and have been informed that I can not sell the photos due to copywright and intelectual infringements. Can anyone give me help on this? Thanks Answer: and have been informed that I can not sell the photos due to copywright and intelectual infringements. Who told you this? Whether or not you can sell the photos depends on from where you took the photos. If you were in an area that was publicy accessible, then you can sell the photos, no problem. Now, there may be some limitations on the advertising of those photos (can't use trademarks in such a way as to cause confusion, etc.), but you are free to sell the photos. If you were taking the photos from a restricted area (i.e., and area where you were required to have a ticket to enter) then you probably can't sell the pictures. The trickier part is if you were in a restricted (paid) area that was also viewable from a publicly-accessible area... Now, all of this said, even if you took the pictures from a public area, that doesn't mean that someone won't try and stop you from selling the pictures -- but at least you'll know something about your legal position... Thank you for your reply. An attourney representing Super boats international. I was on a deck at one of the hotels, they charged a fee to use the deck. Have not used any trade marks or even their name. Again thanks Answer: Thank you for your reply. An attourney representing Super boats international. Answer: **A: why would a fee be charged solely to use the deck? It was free if you had a room but if you were staying in another hotel you had to pay. Copyright © 2006 - 2009 www.todayquiz.com
