Just a guess on I-485 processing time in CSC
Discussion: Hi all, This following analysis is just a guess or so to say, my interpretation on 485 approval. So please don't take it seriously if this is not what you interpret. I will be happy if someone can give a thought on this or comment on this. Today I found out that the processing time for 485 in CSC as "vacant" and so also for I-824DIV I. As per the description all the application till date that have been filed are on some INS officer's desk. Means there are no 485 petitions unassigned. Needless to say that all the 485 petitions will have a verdict in a very short time for all of them. So all the 485 guys who have filed their petition in CSC sit back tight. You will get all your good news soon. On CP: I also got one information from my friends(his attorney informed him) that soon all the priority dates(for EB2 and EB3) will become current within 60 days. That means there will be chicken run for consular processing and another immigration mela(like kumbh mela) in all the three consulates in India. And hence there will be a delay. Anyone willing to debate on this????? Any comments on this analysis or interpretation would be highly appreciated??? Thanks Meenu Answer: Meenu, Your extrapolation is likely to be true. I agree. With the new law, it is expected that PDs become current or at least advance at the rate of 3 months per calendar month. My attorney says to go for AOS as within 6 months you are free. If I choose CP and every one else too, the there is going to be too much rush in the Holy water of Ganges and I may have to wait a long time before getting a Holy Dip! Answer: Anyway I am late to come back again for 485 as I have already filed for my 824. It is like, there is an old saying in hindi(Indian national Language)"Aa Bel mujhhe maar". Can anyone tell me if I can file 485 irrespective of my filing and approval of 824 for changing my 140 from AOS to CP?????? I have searched this site and everyone agrees that it can be doen but no one has claimed that he/she did it. They may have done it but not posted here. Also, I have seen that, this site is ONLY for CP ers. They are all going to Kumbh Mela. They track all activities of INS and post dates. Thanks Answer: Hi all, A good debate here. The faster processing by INS, esp CSC has generated this thread. It is therefore illustrative to look at the CSC processing times report to find out what's happening. I'd have been inclined to take the I-485 coloumn as an example, but will not do so as CSC has reported the dates here with the qualifier 'based on agency checks'. So let me take the example of I-140 . The jump in dates for the past two reports has been a couple of days as opposed to more than 100 ( or ist 200 ) dates in the bulletins prior to that. Not to say that I-485 is not faster. It is quicker and people are getting their GCs in 4-5 months timeframe after filing their I-485s. But By far the biggest advantage of CP is its predictability and ease of approach. With more opting for CP, agreed that the load on NVC has increased. And we have seen processing times at NVC increase by 2 weeks. These days once the file is received by NVC it takes about 2 months for the information to be sent to the consulate abroad. It used to take 2 weeks lesser , last year. Both the NVC and the consulate have been processing cases and are not waiting on them. Over the past 2 years the time for interviews has remained constant . There has been no increae in waiting time . Thus with CP once the case reaches NVC it takes 2+3 = 5 months to get the interview date. Another plus point about CP is that one can always call up and talk to the NVC and the various phases of ur case are well defined and can be tracked as is being done on this bulletin board. One can thus predict as to when the case is sent out from NVC to the consulate. Bth Mumbai and Chennai have email access and the folks there are very responsive. U get replies within 2 days. Having said these points in favour of CP, one does know that the biggest drawback is travel to the home consulate and for the folks where companies pay for the GC processing , fees is also a drawback. Ultimately there is no one fit. People were not aware of CP earlier. Attorneys seldom educate their client about CP. Evrybody should have an informed opinion of AOS and CP processing and base their decision upon that.
