140 Denied and 7th year Ext
  My 140 was denied and appeal was transferred to AAO on Jan 18th 2006. My Perm LC is also pending since Oct 2005. My 6 year is expiring on Jan 2007. In this situation if I move to another employer and can I get 7th extension while transferring my H1B? Also I have a copy of my previous LC but not Appeal Notice from INS. Can I use that LC copy to file for an extension?
Answer:
During appealing your 7th year H-1B is valid. You can use any LC filed at least 365 days to request for the 7th year H-1B transfer although you may be issued a RFE if you never worked for that LC sponsor.
