5 years in H4 visa - can I apply for H1 visa?
  I came to US on November 28, 2001. My spouse LC is cleared and he got 7th year extension. If i apply for H1 visa next year whether I will get H1 visa?

Yes, but your H1 won't be valid after 6 years unless you have your own LC filed more than 365 days ago.
