Hi
I'm on my 7th year in US and it is valid till 12/31/2006 and i havent stamped it yet. As i have approved I-140 i got extension for 3 more years starting 01/01/2007 to 12/31/2009.
I'm going to India on November 24th and coming back on December 27th 2006I have an appointment for stamping my visa on December 11 @ chennai consulate.
Now the problem: Can i come to USA on December 27 if i stamp my new H1
(from Jan 1 07 thru 31 Dec 09) without stamping the current one(from Jan 1 2006 thru 31 Dec 06)? My friend says i cant. I'm confused.
Oh, i cant change the tickets or cancel the tickets bcoz the airline said that they couldnt change or cancel(no refund) the ticket. So i have no other option comking back December 27th 2006. I would be paying for one way tickets from India if i dont fly on December 27 2006.
Is there any way the consulate would give visa for both the papers?
I did the stupid thing by booking the tickets too early...
ANy suggestions?
Thanks

---- Do you have a visa stamped on your Paasport valid till Dec 31, 06 then you can travel ot the US
---- Other option is if the US Consulate stamps a visa on your Passport from the date of your interview that will cover the month of dec.06
---- If there is no visa on your Passport, how do you expect to travel? Wit till the stamping is done on your Passport and then review your options

Hi
Thanks for the information. But the new I797 is valid only from January 1 2007. Also, I don’t have the stamping for current year papers(from Jan 1 2006 to Dec 31 2006). Are you saying that I can travel to USA on Dec 27 2006 with the stamping valid only from Jan 1 2007?
Thanks
