I am on h1b visa status from the past 10 months & have been to india for 3 months. I came back to US 1 month back & haven't got project yet! So my employer, didn't send me any paychecks for the 1 month i have been here.
am i out of status for the past 1 month?
Can i transfer my visa to another employer?
Would a new employer accept me without last immediate month's pay check?

To transfer from one H1B to another you need pay-stubs that are atleast 60 days old. So if you meet this criteria, just find another job quickly.

In your case, you can transfer your H1-B to other employer by procuring a one month leave letter frm your current employer.
As you said that you have been on H1-B for 10months, then for transfering, you need to procure leave letter and the pay-stubs(which are prior to your stay in India).
